Child reunification (Kindernachzug) under §32 AufenthG is the legal pathway for minors to join a parent resident in Germany. The age threshold of 16 is load-bearing — under 16 enjoys broad rights; 16-18 requires either privileged parent status OR child's own German proficiency.
§1 — STATUTORY FRAMEWORK (120-150 words)
§32 AufenthG distinguishes:
(a) Child under 16 (§32(1)):
• Right to reunification with parent(s) holding any permanent or qualifying permit
• No German language requirement
• Standard family reunification documents
(b) Child 16 or 17 (§32(2)):
• REUNIFICATION POSSIBLE if either:
- Child speaks German well enough for integration (typically C1 level), OR
- Reunification serves the best interests of the child due to family circumstances
• Parent holds Niederlassungserlaubnis (§9) OR Daueraufenthalt-EU (§9a)
(c) Child 16 or 17 (§32(3) — privileged categories):
• If parent holds: EU Blue Card §18b, Fachkraft §18a/§18b, ICT §19, researcher §18d, self-employed §21, or asylum-related permit
• Child reunification permitted without German proficiency test
• Same standard as under-16 reunification
For [CHILD_NAME] (age [CHILD_AGE]) joining [PARENT_NAME] holding [PARENT_PERMIT]: determine applicable subsection.
§2 — CUSTODY + SOLE-PARENT ANALYSIS (180-220 words)
For [CUSTODY_STATUS] = "Sole custody":
• Custody order from competent court in [CHILD_LOCATION] required
• Apostilled + sworn German translation
• [PARENT_NAME] must demonstrate legal sole custody
For [CUSTODY_STATUS] = "Joint custody":
• CONSENT from the other parent required
• Form: Notarised written consent (Einverständniserklärung) to child relocating to Germany
• Must be apostilled + translated
• If other parent refuses: court application in home country to vary custody / obtain permission
For [CUSTODY_STATUS] = "Other parent deceased":
• Death certificate (apostilled + translated)
• If [PARENT_NAME] not automatically sole guardian under home-country law: probate / family court order
For [CUSTODY_STATUS] = "Other parent abandoned":
• Affidavit explaining circumstances
• Evidence of parental absence (e.g. court findings, social services records)
• Indian Hindu Marriage Act / Guardians and Wards Act considerations if applicable
• Court declaration of sole custody / guardianship may be required
For Indian families with shared family arrangements (grandparent caregivers, etc.): document the actual caregiver structure clearly. German authorities understand joint-family contexts but require formal documentation.
§3 — VISA APPLICATION PACKAGE (250-300 words)
Submit to German Embassy / Consulate in [CHILD_LOCATION]:
Child documents:
□ National visa application (long-stay D, family reunification)
□ Two biometric photos
□ Passport (12+ months validity)
□ Birth certificate (apostilled + sworn German translation)
□ School records (if applicable — last 2 years)
□ Vaccination records (Impfausweis or equivalent)
□ Medical examination if requested
If [CHILD_AGE] is 16-17:
□ German language certificate (if §32(2) pathway)
- C1 typical bar; lower may suffice if integration prognosis favourable
□ Letter from child stating willingness + integration plan (if 16+)
Custody documents:
□ Birth certificate showing both parents
□ Custody order ([CUSTODY_STATUS] documentation per §2 above)
□ Other parent's consent (if joint custody) — notarised + apostilled
□ Death certificate (if applicable)
□ Marriage certificate / divorce decree (parents' marital status)
Parent ([PARENT_NAME]) documents:
□ Passport + Aufenthaltstitel ([PARENT_PERMIT])
□ Meldebescheinigung
□ Mietvertrag + housing adequacy (typically 10 sqm/child under 6, scaled up)
□ Employment contract + 3 months Lohnabrechnungen
□ Bank statements
□ Krankenversicherung covering child (family GKV typically extends)
□ Schoolplatz / Kindergarten confirmation (recommended but not mandatory)
Visa fee: €37.50 (children under 18; subject to change)
§4 — POST-ARRIVAL STEPS (120-150 words)
Within 14 days:
□ Anmeldung at Bürgeramt
□ GKV registration (child enrolled in parent's family insurance)
Within 90 days (before visa expires):
□ Apply for Aufenthaltserlaubnis nach §32 at Ausländerbehörde
□ Card validity: typically matches parent's permit (1-3 years), or until child turns 18
School enrolment:
• Children 6-15 in compulsory schooling (Schulpflicht)
• Local Schulamt assigns school based on residence
• Welcome class (Willkommensklasse) for new arrivals — intensive German + gradual mainstreaming
• Schoolplatz applications can start before arrival if school confirmed
Health insurance:
• Children under 25 in family GKV coverage free (if not in employment)
• PKV: separate child policy required (parent's PKV may have child rider)
§5 — INDEPENDENT RESIDENCE AT 18 (60-80 words)
When [CHILD_NAME] turns 18:
• Initial child-reunification permit lapses on age threshold
• Application for independent Aufenthaltserlaubnis under §34(2) AufenthG
• Requires: continued residence intent, B1 German proficiency (typically by then), Lebensunterhalt (or studies / training started)
• Niederlassungserlaubnis pathway: §35 AufenthG — special rule for children who came as minors and resided 5+ years
— DRAFT only. Rechtsanwalt (German lawyer) review required before submission. Custody documentation is the most-refused element — Indian state-level custody decrees may need state-government apostille (e.g. Punjab Home Department) in addition to Ministry of External Affairs apostille.
