The Niederlassungserlaubnis is the permanent residence equivalent in German law — a checklist-based grant, not points-based. Be conservative; never promise grant.

§1 — DETERMINE THE APPLICABLE PATHWAY
There are MULTIPLE Niederlassungserlaubnis routes — each with different time and German-language thresholds.
ROUTE A — §9 AufenthG STANDARD (5-year route):
• 5 years lawful residence on Aufenthaltserlaubnis
• B1 German
• 60 months pension contributions (or equivalent — private pension provision counts)
• Self-sufficient
• Sufficient accommodation
• Integration evident
• No serious criminal record
• Default route for most §18a / §18b skilled workers, §28-32 family reunification, §16b students after work transition
ROUTE B — §18c(1) AufenthG (4-year skilled-worker accelerated, post-2023 reform):
• 4 years on §18a / §18b skilled-worker permit
• A2 German (REDUCED from B1 in 2023 reform)
• 48 months pension contributions
• Self-sufficient + accommodation
• Available for [CURRENT_PERMIT] of §18a or §18b
ROUTE C — §18c(3) AufenthG (Blue Card 3-year fast track):
• 33 months EU Blue Card + B1 German + 33 months pension, OR
• 21 months EU Blue Card + B1 German + 21 months pension (faster track with B1 from the start)
• Self-sufficient
• Available for [CURRENT_PERMIT] of §18g (Blue Card)
ROUTE D — §35 AufenthG (children of foreign nationals):
• 5 years on minor's Aufenthaltserlaubnis (typically since 16)
• A1 German for child
• School-attending or vocational training
• Not applicable for the primary applicant adult here
ROUTE E — §9a AufenthG (Daueraufenthalt-EU / EU long-term residence):
• Alternative to §9 — gives EU-wide mobility benefits
• Same 5-year residence + B1 + self-sufficiency requirements
• Useful if client may move to other EU countries later
Cross-reference [CURRENT_PERMIT]:
• §18g Blue Card → Route C (3-year fast-track)
• §18a / §18b → Route B (4-year, A2 German)
• §28-32 family → Route A (5-year, B1)
• §16b student → after switching to §18a/§18b/§18g, then Route B or C
State which Route applies.
§2 — RESIDENCE TIME CALCULATION
For [INTENDED_APPLICATION_DATE] vs. [FIRST_DE_ARRIVAL]:
• Total months in Germany on long-stay basis
• Time on §16b student permit: counted in some routes, not in others (verify current rule)
• Pre-2024 reform: student time generally did NOT count
• Post-Jun-2024 reform (Citizenship Modernisation Act): student / job-search time CAN count toward Niederlassungserlaubnis residence — verify Land-specific practice
For Blue Card Route C:
• Time on Blue Card only counts (not pre-Blue-Card §18b time, generally)
For §18c(1) Route B:
• Time on §18a / §18b counts; pre-§18 time generally does not
State: MEETS / SHORT BY n MONTHS.
§3 — GERMAN LANGUAGE GATE
Cross-reference [GERMAN_LEVEL] with applicable Route:
Route A (standard §9): B1 required
Route B (§18c(1) skilled worker 4-year): A2 sufficient (post-2023 reform)
Route C (§18c(3) Blue Card 3-year): B1 required for fast-track; A2 for slightly-slower variant
Route D (§35 children): A1 sufficient
Accepted B1 proofs:

• Goethe-Zertifikat B1
• TestDaF (3+ in each component, academic)
• DSH-1
• Realschulabschluss / Abitur / Berufsschulabschluss
• German university Bachelor's+ (taught in German)
State: MEETS / NEEDS UPGRADE FROM [current] TO [required].
§4 — PENSION CONTRIBUTIONS GATE
Requirement: 60 months Rentenversicherungsbeitraege (Route A) / 48 months (Route B) / 21-33 months (Route C).
Cross-reference [PENSION_MONTHS]:
• Each month of employment contributes 1 month pension
• Self-employed: if not statutorily covered, can pay voluntary contributions to count
• Private pension provision: alternative if statutory not available
• Parental leave (Elternzeit) months count
• Unemployment Arbeitslosengeld I receipt periods count
• Bürgergeld (welfare) periods do NOT count
Most common gap: clients who switched jobs / had unpaid leave / studied for periods need to count carefully.
