You are computing residence eligibility for [CLIENT_NAME]'s NZ citizenship by grant application under section 8(2)(a) of the Citizenship Act 1977. GROUND RULES (s.8(2)(a)) • 5 years as Resident (or PR) immediately before application • Present in NZ at least 240 days in EACH of those 5 years • Present in NZ at least 1,350 days TOTAL across those 5 years • Day of departure from NZ = day OUT; day of return to NZ = day IN • Both 240-per-year AND 1,350-total must be satisfied — failing either fails residence §1 — DEFINE THE 5 YEARS Window: [APPLICATION_DATE] minus 5 years → [APPLICATION_DATE] RR grant: [RR_GRANT_DATE] (must be on/before window start) Label the 5 sub-years (rolling 365-day blocks ending at [APPLICATION_DATE]): Y5 (most recent): [APPLICATION_DATE − 365 days] → [APPLICATION_DATE] Y4: [APPLICATION_DATE − 730 days] → [APPLICATION_DATE − 365 days] Y3: [APPLICATION_DATE − 1095 days] → [APPLICATION_DATE − 730 days] Y2: [APPLICATION_DATE − 1460 days] → [APPLICATION_DATE − 1095 days] Y1: [APPLICATION_DATE − 1825 days] → [APPLICATION_DATE − 1460 days] §2 — TALLY DAYS IN NZ PER YEAR For each trip in [TRAVEL_HISTORY]: (a) Allocate absence days to the relevant year (split across years if trip spans Y boundary) (b) Absence days = (return_date − departure_date − 1) — both boundary days count as NZ days For each year Y1..Y5: • Year length = 365 days (366 for leap years) • Days in NZ = year length − absence days in that year • State: PASS (≥240) or FAIL (<240) per year Show arithmetic year-by-year, like: "Y3 (2023-Sep-01 to 2024-Aug-31): 5 absences totalling 38 days → 365 − 38 = 327 days in NZ. PASS." §3 — TOTAL DAYS ACROSS 5 YEARS Sum the per-year NZ days = state total. Required: 1,350. Margin = total − 1,350. State: PASS (margin n days) / SHORT BY n DAYS. §4 — IF FAIL: PROJECT EARLIEST ELIGIBLE DATE If any year fails the 240-day minimum: • Wait until that year drops out of the window • Earliest application = that absence's end + 5 years If total is below 1,350: • Continue presence in NZ until total catches up • Earliest application = [APPLICATION_DATE] + days_short (assuming continuous presence) State whichever date is LATEST as the binding constraint. §5 — MINISTERIAL DISCRETION (s.9) If client is short by < 60 days on total OR fails one year by < 30 days: • Minister may waive under s.9 for exceptional / humanitarian circumstances • Document strongly: severity, no fault of applicant, NZ ties retained • Cross-reference None State: STRONG DISCRETION CASE / WEAK / NO BASIS. §6 — OFFICER-FACING NARRATIVE (150-200 words) Draft a paragraph in the applicant's voice explaining absences, suitable for the "Travel and absences" comments section of the DIA online form. For each trip: • Date range • Destination • Stated purpose (verbatim from [TRAVEL_HISTORY]) • Confirm return to NZ • Ties retained during absence (employment continued, lease/home maintained, family in NZ, kids in school) Avoid: "extended", "long stay", "stuck overseas" — flag-words for officer review. If None is non-trivial, weave it in factually with supporting-evidence references. §7 — DOCUMENT THE EVIDENCE For each absence: • Passport stamp page reference • Boarding pass / ticket copies • Employer letter (if work absence) • Medical evidence (if illness) • Death certificate / hospital letter (if family emergency) §8 — OFFICER-RISK FLAGS Flag any of: (a) Any single absence > 90 days — discretionary scrutiny (b) Multiple short trips back to home country — investigate centre-of-life (c) Spouse + children primarily residing offshore (d) Missing entry/exit stamps — request INZ movement records via Privacy Act (e) Tax residency declared as overseas in any of the 5 years — material concern for "intent to reside" End with: "DRAFT residence calculation — for IAA-licensed immigration adviser / NZ immigration lawyer verification against passport stamps and INZ movement records. The applicant remains responsible for accuracy under Citizenship Act 1977 s.27 (false statements). Total + per-year minima both must be met; either failure triggers refusal."
