§1 — WHAT IMPLIED STATUS IS (and is not)
Implied status = remain in Canada UNDER THE SAME CONDITIONS as the expired permit while the extension application is in queue.
Statutory anchors:
• R183(5) — visitors
• R215(1) — students
• R186(u) read with R200(3)(d) — workers (continued employment under prior permit terms)
What it DOES grant:
• Lawful presence in Canada (not "out of status")
• Continued employment (if [PRIOR_STATUS_TYPE] is work permit) on the SAME terms
• Continued study (if [PRIOR_STATUS_TYPE] is study permit) at the SAME DLI
• Continued ability to apply for permits (other applications), renew SIN, etc.
What it DOES NOT grant:
• Any new permission beyond the prior permit (e.g. cannot take a different employer on a closed permit)
• Re-entry to Canada after departure
• Active status documentation (no new physical permit until decision)
• Provincial healthcare in some provinces after permit expiry — verify per province (Ontario maintains OHIP for ongoing residents; some provinces require active permit copy)
§2 — WORK RIGHTS DURING IMPLIED STATUS
If [PRIOR_STATUS_TYPE] starts with "Work permit":
Employer [EMPLOYER_OR_DLI]:
• Continued employment IS permitted on the same NOC, employer (if closed), and hours/conditions
• Employer should receive a copy of the extension submission confirmation (IRCC sends a receipt)
• For Service Canada SIN renewal: SIN extends with valid permit OR with a receipt for an extension application — show the IRCC confirmation
Job change before decision:
• Closed permit: cannot change employer without a new LMIA-based work permit
• Open permit: may change employer freely
• Promotion / role change within same employer + same NOC: typically OK; flag if NOC changes
Hours:
• Continue at same hours allowed under prior permit
If [PRIOR_STATUS_TYPE] is Study permit + client is working off-campus under R186(v):
• Up to 20 hrs/week (or 24 hrs/week per 2024 update — verify current cap) off-campus
• Full-time during scheduled breaks
• Right preserved during implied status as long as still actively enrolled
If [PRIOR_STATUS_TYPE] is Visitor:
• NO work permitted in any case
• NO study permitted in a course > 6 months (short courses < 6 months are exempt)
§3 — STUDY RIGHTS DURING IMPLIED STATUS
If [PRIOR_STATUS_TYPE] is Study permit:
• Continue full-time at [EMPLOYER_OR_DLI]
• Continue holding off-campus work rights under R186(v)
• Co-op work permit (if held separately) continues only as long as it has not expired separately
§4 — TRAVEL DURING IMPLIED STATUS — No
CRITICAL RULE: Implied status DOES NOT extend across international borders.
If No indicates yes (or possibly):
• DEPARTURE = implied status ends on the day of departure
• To return: applicant must have valid TRV or eTA + a valid permit OR Letter of Introduction
• If extension is still pending: applicant cannot return as a "visitor on implied work permit" — they must wait for a new permit or apply for a new TR document from abroad
• Risk: client could be stuck outside Canada for months waiting for decision
Recommendation table:
• No = "Yes" → STRONGLY ADVISE postponing travel until permit issued
• No = "Possibly" → ADVISE waiting if extension < 60 days from filing; OK to consider once a decision is imminent
• No = "No" → confirm and document
If travel is non-negotiable:
• Withdraw the extension application BEFORE departure
• Apply for a new TR document from abroad (TRV / eTA / work permit / study permit) — re-entry pathway
• This often adds 3-6 months to total processing
§5 — HEALTHCARE + SIN + LICENSING DURING IMPLIED STATUS
• Provincial healthcare: varies — Ontario / Alberta / Quebec generally maintain coverage with proof of extension submission; BC has cancelled coverage in some cases at expiry. Confirm per province.
• SIN (Service Canada): valid SIN does not expire with permit; but the "valid until" date on the SIN card may expire. Take IRCC receipt + permit to Service Canada to renew.
• Provincial driver's licence: usually tied to status; carry IRCC receipt with you for renewal interviews
• Bank accounts: typically unaffected
§6 — DECISION DAY SCENARIOS
When decision issues:
Approved:
• New permit emailed (study/work) or mailed (visitor) — typically 5-10 days
• New conditions in effect from the date of issuance, not retroactive
• Same employer / DLI / address continues
• Make a copy; notify employer / DLI / Service Canada / bank as relevant
Refused:
• Implied status ENDS on the date of refusal
• Client has 90 days to seek restoration under R182 (see ca-extension-restoration-of-status-narrative)
• OR must leave Canada
• Cannot work or study during the 90-day restoration window
Issuance with shorter validity than requested:
• Common; do not appeal — apply for the next extension 30 days before the new expiry
§7 — RED FLAGS TO MONITOR
• Client received Procedural Fairness Letter (PFL) from IRCC — respond within stated window (typically 7-30 days); engage RCIC
• Client receives request for biometrics — schedule within 30 days
• Application returned for incompleteness — refile; implied status may have ended depending on timing
• Client's GCMS notes (via ATIP request) show inadmissibility flag — engage RCIC immediately
