§1 — STATUTORY DECLARATION OF FIDELITY (s.19 + Form 8 Part 7)
The applicant signs a statutory declaration affirming they will:
• Be faithful to the Irish Nation
• Loyal to the State
• Faithfully observe the laws of the State
• Respect the democratic values
Procedure:
(a) Statutory declaration must be made BEFORE a person authorised to take statutory declarations:
— Practising Solicitor
— Notary Public
— Commissioner for Oaths
— Peace Commissioner
(b) Cost: typically EUR 10-20 per statutory declaration witnessing
(c) Declaration is on the Form 8 itself (Part 7) — no separate document
(d) Date of signing must be within ~3 months of submission

§2 — WITNESS COORDINATION
Form 8 requires TWO witnesses who certify the applicant's identity and character.

• MUST have known applicant 5+ years (some forms now say 3+; verify current Form 8)
• Acceptable professions: solicitor, barrister, registered medical doctor, dentist, vet, accountant, notary, engineer, school principal/teacher, member of Garda Síochána (Inspector+), member of An Garda Síochána Ombudsman, TD / Senator / MEP / Councillor, religious minister of recognised denomination, peace commissioner
Witness 2: [WITNESS_2]
• Any nationality
• Same 5-year acquaintance and professional standing
• Cannot be the applicant's spouse / immediate family
Each witness completes:
(a) Their part of Form 8 (or a separate declaration if old form)
(b) Signature on official letterhead
(c) Full address (work address acceptable)
(d) Profession + (if regulated) registration number
(e) How long they've known the applicant + capacity (e.g. "doctor-patient since 2019")
What to send each witness 3 weeks before lodgement:
• Cover note explaining what's needed
• A copy of Form 8 (or relevant page)
• Stamped self-addressed envelope OR digital workflow
• Reminder: ISD may contact them DIRECTLY to verify
Common witness pitfalls:
• Witness changes employer between signing and ISD contact (flag — confirm forwarding address)
• Witness's "5 years" overlaps with applicant's residence period unclearly (clarify dates)
• Both witnesses related to applicant (must NOT be — at least one independent)
§3 — GARDA VETTING
ISD checks Garda records as part of character assessment. No separate "Garda vetting" form for citizenship (unlike employment vetting). But ISD will:
(a) Cross-check applicant's PPSN / passport against Garda PULSE system
(b) Cross-reference any past contact (even as witness or victim)
(c) Review any motoring offences, public order matters
Prepare client by:
• Pulling own Garda record via SAR (Subject Access Request) — Data Protection Act 2018
• Drive licence record print-out from NDLS (showing penalty points history)
• Listing every interaction with Garda (even reporting a stolen bike — these may show in PULSE)
• If anything appears that surprises applicant — request correction via Data Protection complaint
§4 — TAX CLEARANCE CERTIFICATE (Revenue myAccount)
Critical — ISD checks Revenue compliance.
(a) Apply via Revenue online (myAccount or ROS for self-employed): Tax Clearance Certificate
(b) Issued instantly if compliant
(c) If not compliant: Revenue will flag — must clear arrears first
(d) Print and attach to Form 8 supporting docs
(e) For self-employed (No = Yes): Form 11 returns for each year of reckonable period, including any preliminary tax adjustments
§5 — LOCAL PROPERTY TAX (LPT)
If No is Yes:
(a) LPT must be current for property owned (Local Property Tax via Revenue)
(b) Any outstanding LPT — pay before lodgement
(c) Print LPT statement showing current year paid
If renting (no property):
• State so explicitly on Form 8 narrative
• Provide lease evidence
§6 — PRSI CONTRIBUTION HISTORY
From MyWelfare (welfare.ie):
• Download "PRSI Contributions Statement" — shows insured weeks per year
• Demonstrates employment history matching stamp record
• Useful corroboration of reckonable residence
§7 — PENALTY POINTS / DRIVING RECORD
Driving licence record from NDLS (ndls.ie):
• Shows current penalty points
• Recent offences (5y)
• If > 6 points OR drink-driving / dangerous driving conviction → flag for ISD; may delay/refuse
§8 — POLICE CLEARANCE FROM OTHER COUNTRIES
For each country resided in 6+ months in last 10 years (other than Ireland):
• India: PCC from VFS or local Indian embassy — ~4-6 weeks; needed within 6 months of lodgement
• UK: SAR to ACRO (acro.police.uk) — Subject Access Certificate
• US: FBI Identity History Summary — 4-8 weeks
• Apostille / Notarisation: may be required by ISD — confirm current policy
§9 — TIMING SUMMARY (pre-lodgement)
T-12 weeks: Request all police certificates (longest lead time)
T-8 weeks: Notify witnesses; send Form 8 page to them
T-6 weeks: Apply for Tax Clearance Certificate
T-4 weeks: Compile bank/utility/employment evidence
T-2 weeks: Witnesses return signed declarations
T-1 week: Sign statutory declaration before solicitor
T-0: Lodge online + post originals
