§1 — DETERMINE WHETHER VARIATION OR NEW APPLICATION
Decision tree:
CHANGE OF AEWV ACCREDITED EMPLOYER:
• Requires NEW AEWV application (or Variation depending on circumstances)
• New employer's Job Check must be approved first
• If same ANZSCO + same hourly rate: variation of conditions possible in some cases
• If different ANZSCO / role / wage: new visa application
• While processing: cannot start new role; old role continues if old employer still active OR 30-day grace post-cessation
CHANGE OF EDUCATION PROVIDER on Student visa:
• If new provider is NZQA-approved + same level: Variation of Conditions form
• Variation fee NZD $400 // verify
• If new provider is different level / different course type: typically new student visa application
• Provider must issue new Offer of Place
ADDING ACCOMPANYING DEPENDANTS:
• Spouse / Partner: Partner of a Worker / Student visa OR Partner of NZer Resident/Citizen visa (separate stream)
• Child: Dependent Child visa (under 18 typically; specific exceptions)
• Each dependant files separate application
• Reference primary's visa number; submit relationship evidence
VARYING SPECIFIC CONDITIONS:
• E.g. removing "study not permitted" condition; permitting second job

• Decided by INZ on merits + sound reason
• Some conditions immutable (employer-tied AEWV requires new visa for change of employer)

• Full document pack — qualifications, experience, character, health, English
§4 — PARTNER OF A WORKER / STUDENT VISA (DEPENDANT APPLICATION)
For No additions:
For Partner of Worker / Student:
A. Online application via inz.govt.nz "Partner of a Worker / Student" pathway
B. Relationship evidence (genuine + stable + exclusive for ≥ 12 months):
• Marriage certificate (apostilled if foreign)
• Joint bank statements, lease, utility bills
• Joint photos (over time, not posed)
• Communication records during separation
• Statutory declarations from witnesses
C. Primary partner's visa evidence (eVisa, passport)
D. Funds evidence (typically waived if primary supports)
E. Police certificates + medical certificates
F. Application fee NZD $441-575 + Immigration Levy // verify
For Dependent Child:
A. Online application via inz.govt.nz "Dependent Child"
B. Birth certificate showing relationship to primary
C. Custody evidence (if separated parents)

§6 — TIMING + INTERIM VISA
For variations + new applications during current visa validity:
• Lodge before [CURRENT_VISA] expires → Section 78 interim visa
• For AEWV employer change: 30-day grace period post-cessation of employment with prior accredited employer to find new (per AEWV instructions); beyond 30 days = visa-condition breach
For dependants joining from abroad:
• Dependant's offshore application processed at relevant INZ post (Mumbai, New Delhi)
• Visa issued; dependant travels to NZ
• Onshore for children already in NZ on Visitor: convert via Dependent Child application
§7 — RED FLAGS
• Employer accreditation expired during AEWV employer change: cannot rely on Job Check
• Education provider lost NZQA approval: invalid; visa cancellation under S.49 risk
• Dependants relationship < 12 months without registered partnership: extra evidence required
• Multiple variations in short period: officers scrutinise stability of arrangement
• Failure to declare prior immigration history of dependant: misrepresentation under S.158
§8 — POST-APPROVAL ACTIONS
• AEWV employer change: notify IRD with new employer; update KiwiSaver
• Education change: new provider files SEVIS-equivalent; old provider closes record
• Dependants joining: register with school / DHB / IRD as applicable; KiwiBank account
• All scenarios: update address with INZ via online account
